Therms and Conditions


·         These General Terms and Conditions of Sale have as their object the purchase of MELITA MAISON products remotely carried out via the telematic network on the sites or, belonging to MELITA MAISON, based in Tombolo (PD), Via Fabio Filzi 40 / a. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99, Legislative Decree. 206/05; the information directed at the conclusion of the contract will be submitted to the art. 12 of the Legislative Decree. 70/03 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree. 196/03.



·         The contracts for the sale of products on the sites or, are considered concluded when the purchase order made by the customer to MELITA MAISON arrives and the latter accepts it. MELITA MAISON will promptly send the customer receipt of the purchase order made by the customer.

·         The customer, with the electronic transmission of his purchase order, declares to have read and accepted these general conditions of contract and is obliged to observe and respect them in its relations with MELITA MAISON.



·         MELITA MAISON pursuant to art. 13 of Legislative Decree 196/2003 informs that personal data and tax records also acquired verbally in reference to the established commercial relations, provided directly by the interested parties, or otherwise acquired within the company's activities, will be processed in compliance with the aforementioned legislation , including the confidentiality obligations set by them

·         In relation to the aforementioned, the rights referred to in Article 7 of the Legislative Decree may be exercised. 196/2003.



·         Before sending the purchase order, the Customer must carefully read these general conditions of sale. The submission of the purchase order implies their full knowledge and acceptance.

·         Finally, once the on-line purchase procedure has been completed, the Customer is obliged to print and keep these general sales conditions, already viewed and accepted during the conclusion of the contract.



·         By sending the order online, the Customer sends MELITA MAISON a proposal to purchase the product and / or products included in the cart. When the Customer places an order online for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale.

·         MELITA MAISON will inform the Customer of the acceptance and confirmation of the order.

·         In particular MELITA MAISON will not accept orders:

·         if the material, when ordering was not available in stock and / or

·         if the customer can not or does not want to pay using credit cards (Paypal), bank transfer or cash on delivery.

·         It is possible to place an order either through the websites or at the prices and conditions stated in the same and at authorized dealers.



·         The customer purchases the product, the characteristics of which are illustrated on-line in the relative descriptive and technical sheets, at the price indicated therein, together with the delivery costs specified on the website. (any costs for cash on delivery are excluded).

·         Before the purchase order is sent, the unit cost of each selected product is summarized, along with the total cost in the case of the purchase of several products and the related delivery costs.

·         Once the purchase order has been submitted, the customer will receive from MELITA MAISON an e-mail message confirming that the purchase order has been received and containing information on the main features of the purchased item, a detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general conditions of contract and information on the existence of the right of withdrawal, on the terms and conditions of its exercise displayed on the site. DELIVERY OF PRODUCTS The purchased good, together with the related invoice, is delivered by courier to the address specified by the Customer when ordering online. Any specific needs must be presented by the customer to MELITA MAISON.MELITA MAISON guarantees the delivery of goods within national borders (excluding Sardinia) within 15 (fifteen) working days from the date of receipt of confirmation of the transaction. (For payment by cash on delivery the 15 days will be counted from the date of receipt of the order by e-mail.). In the event that the customer chooses the cash on delivery method, payment must be made exclusively by cash or cashier's check, to be delivered directly to the courier upon receipt of the goods.When MELITA MAISON, could not guarantee delivery in the the aforementioned terms, an additional 10% discount will be applied to the total cost of the reference MELITA MAISON items. CONFORMITY GUARANTEE AND DEFECTIVE PRODUCTS products purchased on the websites or are subject to the regulation on the sale of consumer goods. The delivered products comply with the characteristics illustrated on-line in the relative descriptive and technical sheets. MELITA MAISON is responsible towards the customer for the conformity defects existing at the time of delivery of the goods. For warranty terms refer to the LIMITED WARRANTY MONDIAL MELITA MAISON, present and downloadable in electronic format on the sites or RIGHT OF WITHDRAWAL The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with MELITA MAISON, without any penalty and without specifying the reason, within 10 (ten) ten working days from receipt of the goods. The right of withdrawal is recognized in to the consumer in relation to any goods purchased by him on the websites or METHODS FOR THE ERSERCICE OF THE RIGHT OF WITHDRAWAL The right of withdrawal is exercised by sending, within the aforementioned term, a written notice to the address of MELITA MAISON by registered letter with acknowledgment of receipt. The withdrawal notice can be sent , within the same period, also by telegram or fax, provided it is confirmed by registered mail with return receipt within the following 48 hours. The product must be returned to MELITA MAISON complete with accessory, instruction manuals and everything originally delivered to the customer, as well as packed in its original envelopes. A copy of the electronic receipt of the order must be attached to the returned product. The costs of returning the goods to MELITA MAISON are charged to the customer. If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, MELITA MAISON is required to reimburse the sums paid by the customer. In particular, MELITA MAISON will proceed free of charge for the transmission the order of re-credit related to the cost of goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the right of withdrawal by the customer. This operation will be carried out by the credit institution issuing the credit card used for payment or by crediting the sum to the bank account indicated by the client. MELITA MAISON has the right to reject any product returned in a manner other than those specified above, as well as products for which the return costs have not been fully paid by the customer, or the methods and times indicated for the communication of the right of withdrawal have not been respected. EXPRESS RESOLUTORY CLAUSE In the event of non-payment of all or part of the purchase price of the goods MELITA MAISON reserves the right to declare pursuant to and for the purposes of art. 1456 of the civil code resolved this contract by sending a written communication to the customer's electronic address. APPLICABLE LAW AND JURISDICTION This contract is governed by Italian law. The jurisdiction and exclusive forum for any legal action brought by the Purchaser under this warranty or any additional legal guarantees will be the Court of Padua. Should MELITA MAISON win in a possible legal action, the plaintiff will have to reimburse MELITA MAISON for expenses, including attorney fees and court fees, incurred by MELITA MAISON for their defense.
